Status of USCIS Amid U.S. Federal Government Shutdown

In light of the current U.S. federal government shutdown, we wanted to provide an urgent update regarding the operational status of the U.S. Citizenship and Immigration Services (USCIS) and its impact on the EB-5 program. 

The good news is that the EB-5 Program at large will NOT be affected by the shutdown. Thanks to the Reform and Integrity Act (RIA) – which IIUSA championed – the EB-5 Regional Center Program is reauthorized through the end of fiscal year 2027. Additionally, USCIS is expected to remain fully operational, with minimal disruption to the adjudication of fee-funded petitions and applications, which includes the entire EB-5 Program.

While a small percentage of staff in congressionally funded USCIS programs may be furloughed, the core infrastructure supporting the EB-5 process remains insulated from the current funding lapse.

We advise all stakeholders to monitor official USCIS and Department of State communications for any site-specific or policy changes. However, at this time, the core EB-5 processing process is expected to continue unchanged.
